Nondiscrimination Policy of South End Village Academy Incorporated
Purpose
This Nondiscrimination Policy sets forth the commitment of South End Village Academy Incorporated (the “School”) to maintaining a racially nondiscriminatory policy as to students and to ensuring equal opportunity for all members of the School community, in accordance with the requirements of the Internal Revenue Code, the Internal Revenue Service (including Revenue Procedure 75-50 and Revenue Procedure 2019-22), the Massachusetts General Laws, and all other applicable federal, state, and local laws.
Racially Nondiscriminatory Policy as to Students
The School admits students of any race, color, and national or ethnic origin to all the rights, privileges, programs, and activities generally accorded or made available to students at the School. The School does not discriminate on the basis of race, color, or national or ethnic origin in the administration of its educational policies, admissions policies, scholarship and loan programs, and athletic and other school-administered programs.
Broader Nondiscrimination Commitment
In addition to the foregoing racially nondiscriminatory policy, the School does not discriminate against any applicant, student, employee, volunteer, or other participant in its programs and activities on the basis of sex, gender identity, religion, creed, sexual orientation, disability, age, ancestry, immigration or citizenship status, military or veteran status, genetic information, or any other characteristic protected by applicable federal, state, or local law. This commitment applies to all aspects of the School's operations, including but not limited to admissions, enrollment, financial aid, scholarships, educational programs, extracurricular activities, athletics, employment, and the provision of services and facilities.
Admissions
The School's admissions process is conducted without regard to race, color, national or ethnic origin, sex, gender identity, religion, creed, sexual orientation, disability, age, ancestry, immigration or citizenship status, military or veteran status, genetic information, or any other characteristic protected by applicable law. All applicants for admission are evaluated on the basis of criteria that are applied uniformly and without discrimination.
Financial Aid and Scholarships
All scholarships, financial aid, and other forms of financial assistance offered by the School are awarded on a nondiscriminatory basis and without regard to race, color, national or ethnic origin, sex, gender identity, religion, creed, sexual orientation, disability, age, ancestry, immigration or citizenship status, military or veteran status, genetic information, or any other characteristic protected by applicable law.
Employment
The School provides equal employment opportunities to all employees and applicants for employment without regard to race, color, national or ethnic origin, sex, gender identity, religion, creed, sexual orientation, disability, age, ancestry, immigration or citizenship status, military or veteran status, genetic information, or any other characteristic protected by applicable law. This commitment extends to all terms and conditions of employment, including but not limited to hiring, placement, promotion, termination, compensation, benefits, training, and professional development.
Publication of This Policy
This Nondiscrimination Policy shall be published and made available in the following manner:
- This policy shall be referenced in all brochures, catalogues, and other written communications and advertising dealing with student admissions, programs, and scholarships.
- This policy shall be prominently displayed on the School's primary publicly accessible internet homepage, or otherwise made known to all segments of the general community served by the School, in a manner consistent with the requirements of the Internal Revenue Service.
- A copy of this policy shall be made available to any member of the public upon request.
Recordkeeping
The School shall maintain records sufficient to demonstrate compliance with this Nondiscrimination Policy, including but not limited to records showing the racial composition of its student body, faculty, and administrative staff, records documenting that scholarships and other financial assistance are awarded on a racially nondiscriminatory basis, and copies of all brochures, catalogues, and advertising relating to student admissions, programs, and scholarships. These records shall be maintained for such periods as may be required by applicable law and the regulations and rulings of the Internal Revenue Service.
Annual Certification
The School shall annually certify its compliance with its racially nondiscriminatory policy in the manner prescribed by the Internal Revenue Service, including by completing Schedule E of IRS Form 990 or, if applicable, by filing IRS Form 5578, or by such other means as the Internal Revenue Service may prescribe.
Reporting Complaints
Any individual who believes that they have been subjected to discrimination in violation of this policy is encouraged to report the matter promptly to the School's President or to such other person as the School's Board of Directors may designate to receive such complaints. The School shall investigate all complaints of discrimination and take appropriate corrective action as warranted. Retaliation against any individual who reports a complaint of discrimination or who participates in the investigation of such a complaint is strictly prohibited.
Applicable Laws
This policy is adopted in compliance with, and the School shall at all times comply with, all applicable provisions of federal, state, and local law relating to nondiscrimination, civil rights, and equal opportunity, including but not limited to Title VI of the Civil Rights Act of 1964, Title IX of the Education Amendments of 1972, Section 504 of the Rehabilitation Act of 1973, the Americans with Disabilities Act, the Age Discrimination Act of 1975, Chapter 151B and Chapter 151C of the Massachusetts General Laws, and Sections 92A and 98 of Chapter 272 of the Massachusetts General Laws, in each case to the extent applicable to the School.
Amendment
This Nondiscrimination Policy may be amended from time to time by the Board of Directors of the School, provided that no amendment shall be adopted that would cause the School to fail to comply with the requirements of the Internal Revenue Code, the Internal Revenue Service, or any other applicable federal, state, or local law regarding nondiscrimination.
Effective Date
This Nondiscrimination Policy was adopted by the Board of Directors of the School on March 23, 2026.
